Privacy Policy
SunWorx Capital is a commercial finance brokerage. We are not a lender and we do not make credit decisions. Our job is to take your information to lenders who might fund your deal.
That means the whole point of what you give us is that some of it gets shared — with lenders, so they can underwrite. This policy explains exactly what we collect, what we pass on, what we hold back, and how you tell us to stop.
1. What we collect
When you apply
- About you: name, email, phone, personal address, date of birth, Social Security number
- About your business: legal name, EIN, business address, type, legal structure, date started, your ownership percentage
- About the deal: amount sought, purpose, product of interest, monthly deposits, credit score range, any existing financing
- Documents you upload: typically the last three months of business bank statements
- Signature record: your typed electronic signature, the date and time, and the IP address the submission came from
When we contact you
We keep a record of calls, text messages and emails between us, including your replies and any request you make to stop being contacted.
2. Credit checks
Checking what you may qualify for uses a soft credit inquiry, which does not affect your credit score. A hard inquiry only happens later, at closing, on certain products — and only after we have spoken with you and you have completed the additional application that product requires.
When you submit an application you authorize SunWorx Capital, its assigns, agents, banks or financial institutions to obtain an investigative or consumer report from a credit bureau or a credit agency, and to investigate the references given on any other statement or data obtained from you.
3. What we do with it
- Assess whether we can place your deal, and with which lenders
- Submit your file to those lenders for underwriting
- Contact you about your application and the offers it produces
- Tell you about financing that may fit your business later
- Keep records we are required to keep, and resolve disputes
4. Who we share it with — and what we hold back
We share your file with lenders and funding sources so they can decide whether to make you an offer. That is the service.
When we submit your application to a lender, we remove your phone number and email address from the document. Lenders receive what they need to underwrite. They do not receive a direct line to you. Communication comes through us unless and until you tell us otherwise.
We also use service providers who help us operate — hosting, email delivery, phone and messaging, document storage. They handle your information only to provide those services to us.
We will disclose information where the law requires it, and in connection with a sale or transfer of the business.
We do not sell your personal information, and we do not rent or trade your contact details to other brokers or marketers.
5. Text messages
Reply STOP to any message from us and you will be removed. Reply HELP for assistance. Message and data rates may apply. Message frequency varies.
We send text messages about financing to business phone numbers. You can opt out at any time by replying STOP, by emailing us, or by telling us on a call. We honor those requests promptly and keep a record so it does not happen again. Opting out of texts does not remove you from email, and the reverse is also true — tell us if you want both stopped.
6. Email
Every marketing email we send carries an unsubscribe link. Use it and you are removed from those sends. We may still email you about an application already in progress.
7. How long we keep it
We keep applications and documents while your file is active and afterward, because a deal that could not be placed this year is often placeable later, and because lenders and regulators can require records after the fact. Ask us to delete your information and we will, except where we are required to keep it.
8. Security
Your information is encrypted in transit and at rest. Documents are stored in non-public storage. Access is limited to people who need it to work your file. No system is perfectly secure, and we will not claim otherwise — but we do not leave your bank statements sitting in an inbox.
9. Your choices
- See what we have. Ask and we will tell you.
- Correct it. If something is wrong, we will fix it.
- Delete it. Subject to records we are required to retain.
- Stop hearing from us. By text, by email, or by any channel.
Depending on your state you may have additional rights. Contact us and we will honor them.
10. Other things worth saying plainly
Not for children. This is a business financing service and is not directed to anyone under 18.
Links to lenders. Once you are on a lender's site or paperwork, their privacy policy governs, not ours.
Changes. If we update this policy the date at the top changes. Material changes will be flagged on this page.
